Terms

By using Oomph you agree to these terms. If you do not agree, do not use it.

1. What Oomph does

Oomph uses AI to generate a creative for a social media ad from text you provide or from a website you point it to. A creative is one still image, one headline and one caption, made together from one brief. You can edit creatives in Editor Lab (text, images, colours, logo and ad sizes) and download them as images at no extra cost.

Reading your website. If you paste a website address, our server fetches that one public page once (with the stylesheets and images it links to), and only if the site's robots.txt allows it. From it we draft a brief (business name, description, offers, prices, colours, logo and images) for you to check and edit. We never log in, never read pages that aren't public, and never keep the page itself; only the brief you choose to use, and any project you save, is kept. Offers, prices and quotes found on a site are not used unless you tick them. By using a brief made from a website, you confirm it's your business's site (or you're allowed to advertise for it) and that you have the right to use any logo and images you tick from it. Check that anything taken from it is current and true.

Video ads and voiceovers (where offered). In Editor Lab you can turn a creative into a short video ad. The video is put together and recorded in your own browser from your scenes, text, images, music and voiceover; we do not render or store your video. Video export is part of the Oomph Studio pack only; the $29 pack does not include it. Voiceovers use voiceover credits, which come with the Oomph Studio pack where it is offered ($49 one time: 30 creatives, 25 voiceovers and video export; no subscription). One credit makes one new voiceover; regenerating the same script with the same voice is free, and a voiceover that fails on our side returns its credit. Voiceover capacity is limited each day and month, so voiceovers can be temporarily busy; when that happens no credit is used. Voiceovers are made with Deepgram's Aura-2 model running on Cloudflare Workers AI, using synthetic voices from a stock library; voice cloning is not offered. When you generate one, you also agree to use it only in ways Deepgram's terms allow (deepgram.com/terms: for example, no unlawful, deceptive or impersonating content), and we may stop voiceovers for anyone who doesn't. They are not a real person speaking for you and must not be presented as a customer, celebrity or expert endorsement. The music included in Editor Lab was made for Oomph, and you may use it in ads you make with Oomph.

Managed campaigns. The Managed campaigns form ("Ask about managed ads") only asks us to contact you; we reply by email within 1 business day. It is not an order and does not charge you. If we agree to run your ads, the price, scope and terms will be set out in a separate written agreement before anything starts.

2. Credits and price

Every new browser gets 3 free creatives. When your credits run out, generation stops until you buy a pack: $29 USD, one time, adds 30 creatives. You can buy another pack whenever your credits run out. There is no subscription and no automatic renewal. Payment is processed by PayPal. One creative uses one credit when you click Generate; if generation fails on our side, the credit is returned. Credits do not expire, are not transferable and have no cash value. We apply free credits first, then paid credits.

Credits are stored on our server against an anonymous ID kept in a cookie in your browser. Clearing cookies or switching browsers can disconnect you from your credits. You can move them yourself with "Restore credits" in the studio: enter your PayPal order ID and the email you paid with, we check both with PayPal, and the unused credits from that purchase move to the browser you are using. Each purchase can be restored once; after that, or if it does not work, email hello@useoomph.com with your PayPal order ID and we will help. Moving your own credits between your browsers this way is not a transfer to another person. Free use is also capped per network (currently 6 free creatives per day, shared by everyone on the same network), and overall daily usage is capped to prevent abuse and control cost, so generation can occasionally be unavailable. If the daily cap is reached, your credits are not used.

3. Refunds

If you are not satisfied with the $29 pack, email hello@useoomph.com within 14 days of purchase with your PayPal order ID. If you have generated no more than 5 creatives from the pack, we will refund the full $29 to your original PayPal payment and remove the remaining credits. If a fault on our side stops the service from working and we cannot fix it, we will refund the unused portion at any time. Free creatives are free and cannot be refunded. A creative counts as generated when the studio returns its image, headline and caption to you. Edits, image downloads and video exports never count toward this number. This does not limit any rights you have under applicable law, or your right to dispute a payment with PayPal.

Oomph Studio pack ($49, where offered). Email hello@useoomph.com within 14 days of purchase with your PayPal order ID. If you have generated no more than 5 creatives and no voiceovers from the Studio pack, we will refund the full $49 to your original PayPal payment and remove the pack's remaining creatives and voiceover credits. Once a voiceover has been generated from the pack, it can no longer be refunded under this rule, because the voice is paid for when it is made. Playing or re-downloading a voiceover you already made, or regenerating the same script with the same voice, does not count as generating a new one. The fault rule above (a fault on our side that we cannot fix) also applies to the Studio pack.

4. Your content and ownership of output

You keep ownership of the text you provide. As between you and us, you own the creatives generated for you (to the extent any rights exist in them), and you may use them for any lawful purpose, including commercial advertising, with or without credit to us. We do not claim a license to your creatives and we do not retain them, except for projects you choose to save in Editor Lab (see Privacy). You give us permission to process your input only as needed to run the service.

Because the output is AI-generated, it may be similar to output other users receive, and copyright protection for AI-generated material may be limited or unavailable in some places. We make no promise that output is unique or that it can be protected by copyright or trademark.

5. AI-generated content

Everything Oomph produces is generated by artificial intelligence. It can contain mistakes, odd images and unintended content. Images are synthetic: they are not photographs of your business, staff, products or results, and must not be presented as such. Review every creative before you use it. Oomph is built to use only facts you supply and to reject common health, income, before-and-after, endorsement and guarantee claims, but it can miss some, and we do not guarantee that it never adds or alters a detail or that images are free of odd or unreadable text. You remain responsible for your ads, so check every line and every image against your own facts. Some platforms require ads containing realistic AI-generated imagery to be labeled; follow their current rules.

6. You are the advertiser

You are solely responsible for the ads you publish. That includes making sure every claim, price, offer and result is true and substantiated; complying with advertising and consumer-protection law (including the U.S. FTC rules on endorsements and testimonials), platform ad policies and any rules specific to your industry; and clearly disclosing any material connection, such as paid or affiliate relationships, sponsored posts or free products (for example with "#ad" or a plain-language statement). Do not use Oomph to create fake reviews, fake testimonials or fake endorsements, or to imply endorsement by any person or brand that has not agreed. Oomph does not provide legal or compliance advice.

7. Acceptable use

You agree not to use Oomph to: break the law; create deceptive, misleading or fraudulent ads; make unsubstantiated health, financial or earnings claims; infringe anyone's intellectual property, privacy or publicity rights; impersonate a person or business; produce hateful, harassing, sexually explicit or violent content, or anything involving minors in a sexual context; submit other people's personal data without a right to do so; paste websites you are not allowed to advertise for, or use voiceovers to imitate a real person; or attempt to evade credit or rate limits (including the short wait of about 15 seconds between creatives), scrape, resell or automate access to the service, or interfere with its operation. We may refuse requests, limit access or remove credits for violations, without refund where the violation is serious.

8. Availability and warranty

Oomph is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We do not warrant that the service will be uninterrupted or error-free, or that output will be accurate, suitable for your purpose or effective. The service depends on third-party providers (Cloudflare, PayPal, Deepgram) and may change or stop at any time.

9. Limit of liability

To the extent the law allows, Align AI Studio is not liable for indirect, incidental, special or consequential damages, lost profits or lost business, or for ads you publish. Our total liability for any claim relating to Oomph is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

10. Changes and contact

We may update these terms; the date above shows the latest version, and continued use means you accept it. Purchases already made keep the terms they were made under. See also our Privacy page. Contact: hello@useoomph.com.
